News from 15 July

From 15 July 2023, Legislative Decree 24/2023 began to take effect, adopted in implementation of Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019, concerning the protection of persons who report violations of Union and containing provisions regarding the protection of persons who report violations of national regulatory provisions.

To be in line with the new regulatory requirements, the WhistleblowingIT project has automatically adapted the questionnaires of users who have adopted one of the project’s standard solutions (PA, SCP, ORG – former offer for SMEs).

In particular, the changes concern the following aspects:

  • Update of the subjective scope of the questionnaire with the provision of all types of subjects entitled to send a report;
  • Update of the objective scope with the provision of the new types of offences provided for by the legislation;
  • Modification of the data retention period which is reduced from the current 18 months to 12 months. Previous reports maintain the deadline already assigned and in any case the recipient can always postpone the expiration date on the single report.

For all custom solutions, however, the project team remains available to implement the necessary updates and changes, depending on the needs of each individual organisation.
